MARITIME SERVICE AGREEMENT & CANCELLATION PROTOCOLS

1. Binding Reservation & Guarantee To ensure the exclusivity of our fleet, all voyages are conducted strictly by prior appointment. A reservation is deemed legally binding upon the issuance of a digital confirmation voucher. Clients are responsible for ensuring receipt of this documentation; our concierge desk remains available for verification at jaisther@openwaterexpeditions.com.

2. Cancellation, Rescheduling & Force Majeure The following protocols apply to individual bookings via openwaterexpeditions.com. Contractual group charters are governed by their specific master service agreements.

  • Standard Cancellation (48+ Hours): Cancellations initiated more than 48 hours prior to the scheduled departure are eligible for a refund, less a 10% non-refundable administrative and merchant processing fee.

  • Late-Stage Cancellation & No-Show: Cancellations within the 48-hour window, late arrivals, or failure to appear at the embarkation point are strictly non-refundable. At this stage, 100% of the service fee is earned to cover pre-allocated maritime assets, crew wages, and perishable provisions.

  • Maritime Authority & Safety: We reserve the right to cancel any departure due to Port Captaincy closures or unsafe weather conditions. In such events, a full reschedule or 100% refund will be provided.

3. Financial Settlement & Processing Fees A 50% non-refundable deposit (except as noted in section 2) is required to authorize vessel dispatch.

  • Surcharges: To account for international merchant processing and cross-border currency regulations, a 5% surcharge applies to PayPal and a 10% surcharge to physical Credit/Debit card transactions at the point of embarkation.

  • Currency Conversion: Rates are quoted in USD for international clarity. Final transactions are processed in MXN at the prevailing bank exchange rate of the transaction date.

4. Liability & Risk Assumption By securing a reservation, the client acknowledges the inherent risks of maritime activities. Open Water Expeditions maintains comprehensive liability insurance; however, guests agree to follow all safety briefings provided by the Captain and Crew.

5. Data Privacy & Digital Governance We adhere to strict data protection standards. We collect IP and demographic data solely to optimize our digital interface and ensure secure transaction processing. By using this platform, you consent to our terms, which may be updated to reflect evolving maritime and digital regulations.

6. Jurisdiction This agreement is governed by the laws of Baja California Sur, Mexico. Any disputes arising from this contract shall be settled within the competent courts of this jurisdiction.
